While everything online is vulnerable to cyber-attacks, I do my best to keep up-to-date with the latest security recommendations to keep my website and the details processed via it secure. If you look at the top left-hand-side next to my website address (in your browser) you should see a little symbol saying that it is secure. This is because I hold a valid security certificate.

 

Your Data

I don’t collect personal data about you. I don’t rent, share or sell your data.

I use an up-to-date professional system to send out my newsletters. This system is legally compliant. If you sign-up to receive my newsletter then I receive the details that you’ve submitted i.e. name and email address. This system also records the location that you are in e.g. state, USA etc.  You can opt-out of my newsletter at any time: there is an UNSUBSCRIBE option on every newsletter that I send (this has always been a legal requirement). For years there have been strict anti-spam rules and these professional newsletter & emailing systems are designed to prevent spam and unwanted emails.

You are welcome to let other people in your household view and read the information in this e-course (many of the featured recipes can be lovely activities for the whole family) but please don’t share it outside of your household. I can also only provide support for one person per enrolment (support via email, comments on the e-course system, live webinar and our private Face Book group) not the whole household! If you are letting others in your household watch these lessons then make sure that they read and watch the Safety Instructions for Foraging, the Medical Disclaimer, the Herbal Medicine Safety Guidelines and the Poisonous Plants lesson. If you are going to share these lessons with people in your household then you must take responsibility for other people in your household using the lessons correctly and safely. I do not accept any liability for this.

I offer support for people enrolled in this course while the course is in season (check the supported dates each year). Support is offered via email, comments on the e-course system, private Face Book group and live webinar. Please note that a fair-usage policy applies to the support that I offer. I cannot be on-call 24 hours a day and I can’t answer dozens of questions day after day on Face Book. Please feel free to ask questions (questions are very welcome and I encourage you to learn from me!) but if anyone starts to bombard me with questions to the detriment of the group and me then I will be forced to draw a line and will indicate what I consider to be a fair amount of support on my part and enforce that.

Our private Face Book group is a place to come together to share our enthusiasm, ask questions and learn from each other. Please be polite to each other. Debate is welcome but insults and rudeness are not. You are welcome to disagree with each other (or me!) but please conduct yourself professionally and politely. Terms & Conditions of Booking E-Classes

  • This is a ticket to attend the e-class/classes on the date/s and time/s listed on the class info. It is non-transferable.
  • Should there be an unforeseen reason that Vivienne is unable to teach the e-class/es on the date/s and time/s listed (e.g. electricity cut, accident, sudden ill health, bereavement etc.) then Vivienne will re-schedule it to another date and will contact everyone by email.
  • Should you not be able to attend the re-scheduled date then you will be offered a refund, credit note or the option to transfer your booking to another class/classes.
  • Gift vouchers can be used towards full or part payment of these classes. Enter your gift voucher code at the checkout (in the coupon code box, and click ‘apply coupon’). If you have any problems doing this then please email Vivienne at info@theherbalhub. com with details of your gift voucher (including the coupon code). If you have lost this don’t worry, simply include what details you do have about your voucher e.g. who purchased it for you, and Vivienne should still be able to trace it.

Terms & Conditions of General Gift Vouchers

  • Gift vouchers are valid for 5 years from date of purchase and are non-refundable.
  • General gift vouchers can be redeemed against the following: Medicinal Herb & Wild Food Foraging Walks; Workshops & Classes (Herbal Medicine, Natural Cosmetic Making, Wild Food), Online Courses, Electronic Books, Online Consultancy Sessions [please note that medical consultations are NOT available online], Herbal Medicine Products (available from my herbal medicine clinic in Ireland only i.e. no international shipping).
  • After purchase the purchaser will receive an immediate email with the links to download 2 colour documents: a colour gift voucher and the instructions for redeeming the gift voucher (there’s also the option to download these from the Shopping Cart screen when you have completed your purchase). Within 24 hours (but usually within a lot less!) the purchaser will receive an email with a unique coupon code. The recipient of this gift needs this code in order to use the voucher (either online or when contacting Vivienne Campbell directly). The purchaser can then print all 3 documents to give to the gift recipient or send them in an email. This process allows the gift vouchers to be redeemable against the varied services, classes and products that Vivienne offers, helps to prevent fraudulent or multiple use of gift vouchers, means that the purchaser is in control of when the gift is sent (no automated emails spoiling the suprise for Christmas day!) and that the gift recipient receives a pretty gift voucher (either printed or in an email) rather than a generic one.

  • To use a gift voucher for an event in person with Vivienne (class, workshop or foraging walk) you must book in advance for the event because places are limited. You can book in to a class, walk or event by browsing Vivienne’s website and booking online entering the coupon code on your gift voucher. Alternatively, please contact Vivienne by email or phone to arrange to use your gift voucher at an event that you’d like to attend. Please include your name and the coupon code on the gift voucher. The same terms & conditions for booking an event in person will apply to a gift voucher used to book one of these events this way.
  • Canceling your attendance at an event that you’ve booked in to: if 2 weeks or more notice is given before the event then you will be offered a full refund or the chance to transfer to another available event. For cancellations received less than 2 weeks before an event no refunds or transfers can be given. You can however send someone in your place.

Terms & Conditions of Online Course Gift Vouchers

  • To make purchasing gift vouchers for Vivienne’s online courses easier, gift vouchers for online courses are designed to be redeemable against a particular online course (i.e. the price of the voucher relates to the price of the course) and purchasing one of these vouchers comes with instructions for the recipient to redeem the voucher and register themselves (setting their login and password info) for the online course. However, should someone want to use this gift voucher for another of Vivienne’s services instead they should simply contact Vivienne with their unique coupon code and she will arrange to transfer the balance of this gift voucher where possible (availability allowing).

A Simple Summary:

1. It is Vivienne’s responsibility to do everything she can to ensure that an advertised class or event takes place.

2. It is Vivienne’s responsibility to ensure that she treats everyone equally and fairly.

3. It is an attendee’s responsibility to do what they can to attend a place that they have booked, or simply accept that they have missed it.

BOOKING POLICY

  • Vivienne runs high quality classes and for this reason the numbers of participants are always restricted to ensure quality of teaching (usually a max of 12 participants per class or 8 participants for hands-on classes).
  • Classes are filled on a first-come, first-served basis. Vivienne does not reserve places for people without payment. Payment of the full workshop fee is required in order to book your place.
  • Some classes and venues are suitable for over 18s only. Please check with Vivienne before booking.
  • The cost is for the workshop and includes the cost of materials used, hand-outs provided and herbal products to take home.
  • Please book in advance! These classes take lots and lots of preparation and require Vivienne to have hand-outs printed, enough stock ordered in and prepared for every class participant and (if on east coast) time to drive and set up on the other side of the country. If a class isn’t full far enough in advance then Vivienne will cancel it.
  • MLM reps: are welcome to attend Vivienne’s classes and learn from her but, she hereby makes it known that she does NOT tolerate people using her classes to recruit customers or more reps for the pyramid scheme product that they use or sell. [MLM means ‘multi-level marketing’ company: sales reps get paid commission to recruit more customers and new sales reps]. Any MLM rep doing this will be told to leave this class and will not receive a refund. Vivienne does not promote or endorse one brand of products at her classes. Instead she clearly teaches people what ingredients actually are, how to use them safely and joyfully, and gives a list of reliable suppliers of the highest quality ingredients. Vivienne does NOT receive a commission from these suppliers: they are my genuine recommendations based her years’ of experience as qualified herbalist, international educator and professional natural skincare formulator.

Cancellation, transfer & refund policy:

1. Cancellation by YOU the client.

IMPORTANT NOTE: The 2 week cancellation time period referred to here applies to classes in Ireland. For events abroad (due in 2019) a longer time period will apply due to the increased advance costs of running these (costs of flights, visa etc.). This will be included in the event info when they are listed in early 2019.

  • Cancellations received 2 weeks or more before classes and events will receive a full refund or the offer to transfer your booking to another similar event at a future date. 2 weeks or more gives Vivienne reasonable time to re-list and re-advertise your place to try to re-sell it.
  • Cancellations received 2 weeks or less before classes and events: Strictly no refunds or transfers for these. There are no exceptions to this rule. 2 weeks or less does NOT give Vivienne reasonable time to re-list and re-advertise your place to try to re-sell it. It is not uncommon for as many as 25% of the people who have booked in to an event to get in touch 1 week or less before it takes place wanting to cancel or transfer their  booking, hence it’s impossible for Vivienne to have time to re-list, re-advertise and re-sell these places (remember that at this stage, she is also working very long hours preparing the class!). Her responsibility is to the people who are actually coming to the class, not the people who have changed their mind about coming to it. You are however welcome to send someone else in your place (meaning that you can sell your place to them and re-coup your money that way). Should you chose to do this, please contact me for details of how to proceed.
  • Why are there no exceptions to the 2 week cancellation policy?: In life unexpected and rotten things happen but Vivienne is NOT responsible for these things when they happen to other people (she IS responsible for them when they happen to her though: see info on Cancellation by ME, the teacher & event organiser). Whether people have genuine reasons for cancelling such as illness, funerals, cars breaking down etc or more superficial reasons (e.g. a stray dog has turned up, a person forgot about the class and missed it, change of mind etc..in 20 years of teaching I’ve heard all sorts of ‘reasons’!)  Vivienne cannot refund money after this time because these classes cost a lot of time, effort and money (most of which is spent BEFORE the class takes place) and this would make them impossible to run. It is not uncommon for as many as 25% of the people who have booked in to an event to get in touch 1 week or less before it takes place wanting to cancel or transfer their  booking. It is impossible for Vivienne to cover these requests. The price of classes and events are consistently set at fair-trade prices to ensure that all suppliers and Vivienne are paid for their work. Vivienne considers it unethical to run classes and events any other way.
  • OK I now understand why Vivienne has this cancellation policy but I can’t make her event and part of the workshop fee is for material costs so why won’t she send me my materials?: This is because it takes lots of time and money to sort these out and post them to you. It is rare for only one person to cancel last minute, usually several people do so. Vivienne does not have time to bag up individual packages of recipes, handouts, materials etc and post them afterwards nor is she prepared to pay someone else to do this for her. This job can easily take half a day. She also hires and travels to the venues that she teaches at. Staying on to do these extra jobs at these venues would require paying more rent and in some cases paying over time for the staff at the venue too. Not viable without whacking up the cost of the workshops!  If someone booked a concert and missed it he/she wouldn’t expect a refund on his/her ticket or the band to turn up at his/her house on a future date and play for them. It’s the same for my classes and events. They take place on the date and time advertised and that’s it.

Cancellation, transfer & refund policy:

2. Cancellation by ME the teacher & event organiser

It is rare that Vivienne has to cancel a  class or event that has been organised but it does happen from time to time. It can happen for the following reasons:

  1. Event/class cancelled due to low bookings (adequate advanced notice): if Vivienne hasn’t received enough bookings in advance to make her advertised event viable to run then she will have to cancel it. People are usually given 2 weeks notice of this. They are offered a full refund of fees or the chance to transfer their booking to another event.
  2. Event/class cancelled due unforeseen life events (last minute notice): this can happen due to sudden illness, death in the family, funeral, car break down or car crash etc (these things happen in Vivienne’s life too!). In these circumstances every effort is made to contact all participants as quickly as possible ( e.g. by phone.) to allow for minimal inconvenience and disruption to people’s lives. As soon as Vivienne is available the full refund will be offered for the event/class fees or the option to transfer the booking to the same event/class on a future date (it is Vivienne’s responsibility to offer the re-scheduled event as soon as is viable). Where people have booked and paid for accommodation and/or already started their journey, Vivienne will also refund their travelling and accommodation costs (proof of booking must be sent to Vivienne).

CANCELLATIONS, REFUNDS & RETURNS
All sales of digital products downloadable upon confirmation of purchase are final. All live online workshops, courses and trainings being given during a specific time period are eligible for refunds under our started guarantee as stated on each online workshops, courses and training information page. After that time period has passed, no refunds will be given. Vivienne Campbell does not accept cancellations once your order is placed.

While we try to be as clear as possible in explaining the Service, please do not accept that the Site is entirely accurate, current, or error-free. CHANGE OF TIME FRAMES

Vivienne Campbell offers flexible training and development time frames. If you require to extend any time frames we will do our best to assist you, however we reserve the right to charge an extra fee for timeframes that are changed after initial start date.

WEBSITE DEVELOPMENT

Following term & conditions are general, and may be amended for non general projects.

The agreement contained in the contract constitutes the sole agreement between The client and VIVIENNE CAMPBELL regarding all items included in this agreement.
This agreement becomes effective when payment is received in full and email is received with “I agree to the terms and conditions” by The client. Regardless of the place of signing of this agreement, The client agrees that for purposes of venue, this contract was entered into in Vic and any dispute will be litigated or arbitrated in Vic.
Once project fee is paid in full to VIVIENNE CAMPBELL any elements of text, graphics, photos, contents, trademarks, or other artwork furnished to The client for inclusion in website are owned by The client
VIVIENNE CAMPBELL assumes The client has permission from the rightful owner to use any images or design elements that are provided by The client for inclusion in the website, and will hold harmless, protect, and defend VIVIENNE CAMPBELL from any claim or suit arising from the use of such elements.
VIVIENNE CAMPBELL retains the right to display graphics and other Web content elements as examples of their work in their portfolio and as content features in other projects. VIVIENNE CAMPBELL also retains the right to place a text link on the bottom of every page of the website.
Any changes to the above timelines are possible if the The client provides VIVIENNE CAMPBELL with adequate notice of a late due date and it is given in writing with at least 3 days notice (eg. sometimes people have last minute work commitments).
Dates given in the above timeline are the longest you can take, clients are welcome (and encouraged) to provide content and approvals earlier than scheduled.
Due to the cost of securing coding specialists & graphic designers to complete tasks, all work submitted after deadlines will incur a fee of $200 per day unless agreed otherwise.
Right to Revise. In regards to the SEO and remarkerting -At the end of [initial term – 30 days] either party may end the agreement by giving the other party 30 days notice in writing or by electronic mail.
Time Frame Guarantee – VIVIENNE CAMPBELL guarantees that the website will be finalised and handed over in full to The client by the date stated on the document “VIVIENNE CAMPBELL Services Agreement”. Unless held up for any reason by The client, in this case the guarantee is no longer valid and VIVIENNE CAMPBELL will do it’s best to finish the project in the quickest time possible.
Design Guarantee – If after completing in full the design and development brief provided by VIVIENNE CAMPBELL, and after the first design stage has been completed, if The client does not think VIVIENNE CAMPBELL understands the design brief supplied, and if discussions are not providing the results required, The client can cancel the project and ask for a full refund before signing off on the design.
Termination. Client and Consultant enter into this agreement at will. Either party may cancel at any time, for any reason, after a period of 1 month from the The client with express written notice (including electronic mail) to the other party. Any invoiced work not yet paid for must also be promptly paid within 10 business days.
Settlement of Disputes. Any dispute arising between the parties as to the construction or interpretation of this Contract shall be referred to an independent adviser agreed upon between the parties for a declaration of meaning. Where this does not resolve the dispute, the matter shall be referred to the services of a professional mediator to mediate the dispute. Formal legal proceedings shall only be instituted as a last resort.
Acknowledgement. The Client acknowledges that:
a) All websites are built in WordPress. WordPress is highly customisable but limited inside the chosen theme, the client must state all requirements which are needed at the time of brief, at the time of the 1strevision VIVIENNE CAMPBELL will do it’s best to provide as many changes required as possible. Due to the nature of WordPress there are limitations in which features can be changed, if the client believes they require a customised site, then this cannot be done in the “Basic” & Custom” packages and packages offered. For highly customised websites, the Full Customised packaged is designed for this.
b) VIVIENNE CAMPBELL will do it’s best to design the website as per the clients instructions, however design elements may not always be guaranteed as it may not be suitable for esthetic or functional reasons. This will all be discussed at the design stage.
c) Search Engine Optimization results can fluctuate and there are risks involved due to uncontrollable third party factors. All work is carried out at the highest level possible.
d) No responsibility is taken for any changes to the website after the website has been transferred to your account. Vivienne Campbell will do it’s best to help in the first 10 days after completion, however errors, bugs and changes made after this time may require client to pay for additional work.

COURSE PACKAGES

During our initial session we will discuss your desired income level and the way in which we can achieve that. If you follow my training and my recommendations and you don’t see the results we discussed during the first meeting within the time frame we agreed to, then you are entitled to either extra private coaching/mentoring, or a refund of your coaching payment.

Your personal business strategies will never be shared with anyone unless your consent has been provided in writing.

All course content provided to you is for your own use only. This can not be passed onto a 3rd party. Vivienne Campbell retains full copyright of all content.

MATERIAL YOU SUBMIT TO THE SITE

You retain copyright and any other rights you may rightfully hold in any content that you submit through the Site or Service. Content you submit to Vivienne Campbell remains yours to the extent that you have any legal claims therein. You agree to hold Vivienne Campbell harmless from and against all claims, liabilities, and expenses arising out of any potential or actual copyright or trademark misappropriation or infringement claimed against you. By posting material on the Site, you grant us a worldwide, nonexclusive, irrevocable license to use the material for promotional, business development, and marketing purposes.

OUR INTELLECTUAL PROPERTY

IN NO EVENT SHALL VIVIENNE CAMPBELL CUMULATIVE LIABILITY TO YOU EXCEED THE TOTAL PURCHASE PRICE OF THE SERVICE YOU HAVE PURCHASED FROM VIVIENNE CAMPBELL, AND IF NO PURCHASE HAS BEEN MADE BY YOU VIVIENNE CAMPBELL CUMULATIVE LIABILITY TO YOU SHALL NOT EXCEED $100.

You shall not settle any third party claim or waive any defence without our prior written consent.

EFFECT OF HEADINGS
The subject headings of the paragraphs and subparagraphs of this Agreement are included for convenience only and shall not affect the construction or interpretation of any of its provisions.

ENTIRE AGREEMENT; WAIVER
This Agreement constitutes the entire agreement between you and Vivienne Campbell pertaining to the Site and Service and supersedes all prior and contemporaneous agreements, representations, and understandings between us. No waiver of any of the provisions of this Agreement by Vivienne Campbell shall be deemed, or shall constitute, a waiver of any other provision, whether or not similar, nor shall any waiver constitute a continuing waiver. No waiver shall be binding unless executed in writing by Vivienne Campbell.

NOTICES
All notices, requests, demands, and other communications under this Agreement shall be in writing and properly addressed as follows:

GOVERNING LAW; VENUE; MEDIATION
This Agreement shall be construed in accordance with, and governed by, the laws of the Province of Ireland as applied to contracts that are executed and performed entirely in Ireland. The exclusive venue for any arbitration or court proceeding based on or arising out of this Agreement shall be Essex County, Ireland. The parties agree to attempt to resolve any dispute, claim, or controversy arising out of or relating to this Agreement by mediation, which shall be conducted under the then current mediation procedures of The CPR Institute for Conflict Prevention & Resolution or any other procedure upon which the parties may agree. The parties further agree that their respective good faith participation in mediation is a condition precedent to pursuing any other available legal or equitable remedy, including litigation, arbitration, or other dispute resolution procedures.
RECOVERY OF LITIGATION EXPENSES
If any legal action or any arbitration or other proceeding is brought for the enforcement of this Agreement, or because of an alleged dispute, breach, default, or misrepresentation in connection with any of the provisions of this Agreement, the successful or prevailing party or parties shall be entitled to recover reasonable attorney’s fees and other costs incurred in that action or proceeding, in addition to any other relief to which it or they may be entitled.

SEVERABILITY
If any term, provision, covenant, or condition of this Agreement is held by an arbitrator or court of competent jurisdiction to be invalid, void, or unenforceable, the rest of the Agreement shall remain in full force and effect and shall in no way be affected, impaired, or invalidated.

ASSIGNMENT
These Terms and Conditions bind and inure to the benefit of the parties’ successors and assigns. These Terms and Conditions are not assignable, delegable, sublicenseable, or otherwise transferable by you. Any transfer, assignment, delegation, or sublicense by you is invalid.

I can also only provide support for one person per enrolment (support via email, comments on the e-course system, live webinar and our private Face Book group) not the whole household!
